Balwin Strand Athletics Club Terms and Conditions

1. PHOTOGRAPHY, VIDEO FOOTAGE AND PUBLICITY

1.1. I acknowledge that photographs, video recordings and other visual material may be captured during Club activities, training sessions, races, events, prize-giving ceremonies, podium presentations and other occasions where I participate in or represent the Club.

1.2. I consent to the Club using photographs, video footage and other visual material in which I appear, including material showing me wearing Balwin Strand Athletics Club attire, for legitimate Club-related purposes, including social media publications, the Club’s website, promotional material, newsletters, publicity, reports and the celebration of Club achievements.

1.3. Such material may be published on the Club’s official communication channels and social media platforms, subject to applicable South African law, including the Protection of Personal Information Act 4 of 2013 (“POPIA”), and any applicable rights relating to privacy and personality.

1.4. The Club shall not knowingly use such material in a misleading, defamatory or unlawful manner. This consent does not authorise the use of my image for unrelated commercial endorsements or purposes beyond the scope described above without any additional consent required by law.

2. COMPULSORY CLUB ATTIRE WHEN REPRESENTING THE CLUB

2.1. When participating in an event, race, competition, award ceremony, prize-giving or podium presentation as a representative of Balwin Strand Athletics Club, I am required to wear the official Club attire prescribed by the Club, subject to reasonable practical, medical and event-specific requirements.

2.2. Where I win a prize, receive an award or represent the Club on a podium, I undertake to wear the official Club attire when receiving the award or participating in the relevant presentation, unless an exception is approved by the Club or the event organiser.

2.3. I acknowledge that wearing official Club attire promotes Club identity, unity, visibility and the professional representation of Balwin Strand Athletics Club.

3. UNOFFICIAL TRAINING RUNS, WEEKDAY TRAINING AND WEEKEND PACE RUNS

3.1. I acknowledge that weekday training runs, informal group runs and weekend pac runs may take place outside formally organised Club events and may not be supervised, managed, marshalled or controlled by the Club or its appointed representatives.

3.2. I understand that running and athletic activities involve inherent risks, including, but not limited to, physical exertion, dehydration, heat-related illness, falls, collisions, traffic incidents, adverse weather conditions, medical emergencies, injury, illness and, in serious cases, permanent disability or death.

3.3. I voluntarily choose to participate in these activities and accept the ordinary and inherent risks associated with running, having regard to my own physical condition, abilities and circumstances.

3.4. I acknowledge that I am responsible for assessing my fitness to participate, taking appropriate precautions, carrying any necessary medication, following applicable road-safety rules and obtaining medical advice where reasonably necessary. I undertake to inform the relevant organiser of any material medical or safety concern that may affect my safe participation.

3.5. To the fullest extent permitted by South African law, the Club, its committee members, office-bearers, volunteers, coaches and pace leaders shall not be liable for injury, illness, medical emergencies, loss or damage arising from my voluntary participation in unofficial training runs or weekend pace runs, except to the extent that such liability cannot lawfully be excluded, including where liability arises from gross negligence or other conduct for which exclusion is prohibited by law.

3.6. I understand that the Club may not have medical personnel, emergency medical services or immediate access to emergency assistance present at unofficial training runs or pace runs. I acknowledge that any assistance provided by a fellow runner, volunteer, pace leader or Club representative is not a guarantee of medical treatment or a particular outcome.

3.7. Nothing in this clause prevents me from exercising any rights that cannot lawfully be waived or excluded under applicable South African law.

4.3. I understand that this disclaimer must be interpreted and applied subject to applicable South African legislation, including the Consumer Protection Act 68 of 2008, where applicable, POPIA and other relevant legal requirements.
